1. What RizzBay is

RizzBay (rizzbay.com) is operated by [Operator legal name], [registered address], [company number]. It is a listings platform where owners of vehicles, properties, studios, venues and other assets ("owners" or "vendors") advertise them for short-term hire for photo and video shoots, and creators, influencers and production teams ("creators") find them and get in touch.

RizzBay is the introduction, not the transaction. We are not a party to any hire, booking, rental or agreement made between a creator and an owner. We do not hold deposits, take payment for hires, insure anything, supply vehicles or premises, or act as anyone's agent. When you hire something you found on RizzBay, your contract is with the owner, on whatever terms the two of you agree.

2. Who can use RizzBay

You must be 18 or over to use RizzBay. Owners must have the legal right to hire out what they list, whether they own it or are authorised by the owner. If you use RizzBay for a business, you confirm you are allowed to bind that business to these terms.

We can refuse, suspend or close any account at our discretion, including where we believe a listing is not genuine, a user is unsafe to deal with, or these terms have been broken.

3. Your account

Give us accurate information and keep it current. You are responsible for everything done through your account, so keep your login private. Creators' handles and profile links are shown to owners when they enquire; that is how an owner knows who they are talking to.

We may contact you by email about your account, your listings, enquiries and the platform. Marketing email is separate and you can opt out of it at any time.

4. Listings and verification

Before an owner's listings go live we ask for identification and evidence that they own, or are authorised to hire out, the asset. We review each listing before it is published and again after material edits. Verification and review are checks we run for the benefit of the platform; they are not a guarantee of anything, and passing them does not make RizzBay responsible for the listing.

Listings must be accurate and must describe something the owner can actually supply. Photographs must be of the actual asset. Prices shown are indicative day rates set by the owner.

• No listing may offer anything illegal, stolen, unsafe, or that the owner is not entitled to hire out.
• No listing may be used to advertise anything other than the asset itself, or to collect creators' details for another purpose.
• We may edit, hide or remove any listing, and we may remove the "Checked by RizzBay" badge at any time.

5. Enquiries and hires

Creators can reveal an owner's contact details and send a quote request once they have a free account. Contact details are for arranging a hire and nothing else. Scraping, bulk collection or reselling of contact details is prohibited and we rate-limit reveals to stop it.

Everything after the introduction is between the creator and the owner: whether to go ahead, the price, deposit, insurance, dates, access, damage, cancellation and anything else. Agree it in writing before the shoot. RizzBay is not involved in, and takes no responsibility for, the performance of any hire, the condition or availability of any asset, the conduct of any user, or any loss, damage or injury arising from a hire.

Payments for hires are made directly between the creator and the owner. RizzBay never takes payment for a hire and never asks for one. If anyone claiming to be RizzBay asks you to pay for a hire through us, it is not us.

6. Fees and subscriptions

Creator accounts are free. Owners pay a subscription to list. The current plan, Plus, is £99 a month including VAT for up to three live listings, billed monthly by card through Stripe until cancelled. Cancellation takes effect at the end of the paid month; listings stay live until then and are unpublished after.

Founding vendors receive the first three months free. A payment card is required at sign-up and the first charge is taken when the free period ends unless the subscription is cancelled before then. We will email you before that happens.

If a payment fails we will try again and let you know. Listings stay live for a short grace period and are unpublished if payment is not received. Nothing is deleted; paying restores them. Prices may change with at least 30 days' notice; existing subscribers keep their price until their next renewal after that notice.

7. Your content

You keep ownership of the photographs, descriptions and other content you upload. By uploading it you give RizzBay a worldwide, royalty-free licence to display, reproduce, resize and promote it on RizzBay and in RizzBay's own marketing, for as long as it is on the platform and for a reasonable period after to allow caches and backups to clear. You confirm you have the right to grant that licence, including for anyone who appears in the images.

Content produced at a shoot belongs to whoever the creator and owner agree it belongs to. RizzBay claims no rights in it.

8. Reviews and reports

Reviews can only be left after a real enquiry and are moderated by RizzBay before they appear. Owners can reply publicly to a review but cannot remove it. We may decline to publish a review that is abusive, unrelated to the hire, or that we believe is not genuine.

Every listing and profile has a report button. We look at every report. Listings with several open reports are hidden automatically while we check.

9. Safety

Read the Safety page before your first hire. It covers meeting safely, deposits, insurance, NDAs and what to do if something feels wrong. It is guidance, not advice, and following it does not transfer any responsibility to RizzBay.

10. What we are not responsible for

RizzBay is provided as it is. We do our best to keep it accurate and available but we do not promise that it will be, that any listing is accurate, that any owner or creator will respond or perform, or that any hire will go as planned.

To the fullest extent the law allows, RizzBay is not liable for any loss, damage, injury, cost or claim arising from a hire, from a listing, from another user, or from your use of the platform, including loss of profit, data or opportunity. Where liability cannot be excluded, our total liability to an owner is limited to the subscription fees that owner paid to us in the twelve months before the claim, and to a creator is limited to £100.

Nothing in these terms excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to exclude. If you are a consumer, your statutory rights are unaffected.

11. Indemnity

If a third party brings a claim against RizzBay because of something you listed, uploaded, did or failed to do, you will cover our reasonable costs and losses in dealing with it.

12. Ending things

You can close your account at any time from your account settings or by emailing us. We can suspend or close accounts, and remove content, where these terms are broken or where we reasonably think the platform or its users are at risk. Sections 7, 10 and 11 survive the end of these terms.

13. Changes to these terms

We may update these terms. For changes that matter to you we will give at least 30 days' notice by email or on the platform. Continuing to use RizzBay after that is acceptance of the new terms.

14. Law and disputes

These terms are governed by the law of England and Wales and the courts of England and Wales have exclusive jurisdiction, except that consumers in other countries keep the protection of their local law where it applies.
